ความเป็นมา

 

คณะรัฐมนตรีได้มีมติเมื่อวันที่ ๒๔ กรกฎาคม ๒๕๕๕ เห็นชอบให้จัดตั้งศูนย์ปฏิบัติการต่อต้านการทุจริตคอร์รัปชันของแต่ละส่วนราชการ ตามกรอบยุทธศาสตร์ แนวทาง และแผนงานเชิงรุกของรัฐบาลในการต่อต้านการทุจริตในสมัยนั้น ทั้งนี้ เพื่อยกระดับการต่อต้านการทุจริตของประเทศไทยให้อยู่ในระดับมาตรฐานสากล และสร้างภาพลักษณ์ที่ดี และความเชื่อมั่นศรัทธาในการบริหารราชการแผ่นดิน

คณะรัฐมนตรีได้แถลงนโยบายต่อสภานิติบัญญัติแห่งชาติ เมื่อวันที่ ๑๒ กันยายน ๒๕๕๗ กำหนดให้ การส่งเสริมการบริหารราชการแผ่นดินที่มีธรรมาภิบาล การป้องกันปราบปรามการทุจริตและประพฤติมิชอบในภาครัฐ และการปรับปรุงกฎหมายและกระบวนการยุติธรรม เป็นนโยบายสำคัญในการบริหารงานของรัฐบาล ประกอบกับคณะรักษาความสงบแห่งชาติได้มีคำสั่ง ที่ ๖๙/๒๕๕๗ เรื่อง มาตรการป้องกันและแก้ไขปัญหาการทุจริตและประพฤติมิชอบ ลงวันที่ ๑๘ มิถุนายน ๒๕๕๗ ซึ่งกำหนดให้ทุกส่วนราชการและหน่วยงานของรัฐกำหนดมาตรการหรือแนวทางการป้องกันและแก้ไขปัญหาการทุจริตและประพฤติมิชอบในหน่วยงาน โดยมุ่งเน้นให้ทุกภาคส่วนร่วมกันบูรณาการแก้ไขปัญหาการทุจริตให้เกิดผลสัมฤทธิ์เพื่อสนองความต้องการของสังคมและประชาชนอย่างยั่งยืนโดยเร็ว

เมื่อวันที่ ๑๙ สิงหาคม ๒๕๕๙ นายกรัฐมนตรีได้ประกาศให้การปราบปรามการทุจริตเป็น “วาระแห่งชาติ” โดยเน้นว่าการแก้ไขปัญหาต้องเริ่มจากจิตสำนึกของแต่ละคน ครอบครัว โรงเรียน ชุมชน สังคม และประเทศชาติ การมีค่านิยมส่งเสริมคุณธรรม ศีลธรรม จริยธรรม ธรรมาภิบาล

กลไกการแก้ปัญหาการทุจริตภาครัฐมี ๓ ระดับ คือ

๑.      คณะกรรมการต่อต้านการทุจริตแห่งชาติ (คตช.) เป็นกลไกระดับนโยบาย โดยมีนายกรัฐมนตรี/หัวหน้าคณะรักษาความสงบแห่งชาติ เป็นประธานกรรมการ (ตามคำสั่ง คสช. ที่ ๑๔/๒๕๕๘ ลงวันที่ ๒๗ ตุลาคม ๒๕๕๘)

๒.      ศูนย์อำนวยการต่อต้านการทุจริตแห่งชาติ (ศอตช.) จัดตั้งขึ้นภายในสำนักงานคณะกรรมการป้องกันและปราบปรามการทุจริตในภาครัฐ เป็นกลไกประสานการขับเคลื่อนในภาพรวมของประเทศ โดยมีรัฐมนตรีว่าการกระทรวงยุติธรรม เป็นประธานกรรมการ (ตามคำสั่งสำนักนายกรัฐมนตรี ที่ ๒๒๖/๒๕๕๗ ลงวันที่ ๒๔ พฤศจิกายน ๒๕๕๗)

๓.      ศูนย์ปฏิบัติการต่อต้านการทุจริต (ศปท.) ระดับกระทรวง เป็นกลไกขับเคลื่อนแผนการป้องกันและปราบปรามการทุจริตและการส่งเสริมคุ้มครองจริยธรรมในส่วนราชการ โดยมีรองปลัดกระทรวงทำหน้าที่เป็นหัวหน้า ศปท. (ตามมติคณะรัฐมนตรี ลงวันที่ ๒๔ กรกฏาคม ๒๕๕๕) 

การดำเนินการของกระทรวงการต่างประเทศ

กระทรวงการต่างประเทศได้กำหนดให้ศูนย์ปฏิบัติการต่อต้านการทุจริต (ศปท.) เป็นหน่วยงานหนึ่งในสำนักงานปลัดกระทรวง เพื่อทำหน้าที่หลักในการบูรณาการและขับเคลื่อนแผนการป้องกันและปราบปรามการทุจริตและการส่งเสริมคุ้มครองจริยธรรมในกระทรวง รับผิดชอบงานขึ้นตรงต่อปลัดกระทรวง รวมทั้งได้กำหนดอำนาจหน้าที่ของ ศปท. ไว้ด้วย (ตามกฎกระทรวงแบ่งส่วนราชการสำนักงานปลัดกระทรวง กระทรวงการต่างประเทศ (ฉบับที่ ๓) พ.ศ. ๒๕๕๖ ลงวันที่ ๕ สิงหาคม ๒๕๕๖) และ ต่อมา ได้มีคำสั่งแต่งตั้งคณะทำงาน ศปท. กระทรวงการต่างประเทศ เมื่อวันที่ ๓๐ มิถุนายน ๒๕๕๗ โดยมีผู้แทนหน่วยงานต่าง ๆ ภายในกระทรวงการต่างประเทศเข้าร่วมในองค์ประกอบคณะทำงานด้วย

เพื่อให้การปฏิบัติงานของ ศปท. เป็นไปอย่างมีประสิทธิภาพ และเป็นปัจจุบัน กระทรวงการต่างประเทศได้แต่งตั้งผู้ปฏิบัติงาน โดยมีรองปลัดกระทรวงการต่างประเทศ กลุ่มภารกิจส่งเสริมกิจการต่างประเทศเป็นหัวหน้า ศปท.  มีเอกอัครราชทูตประจำกระทรวงเป็น รองหัวหน้า ศปท. และมีข้าราชการในสำนักงานปลัดกระทรวงเป็นผู้ปฏิบัติงานทั้งใน (๑) กลุ่มงานคุ้มครองจริยธรรม และ (๒) กลุ่มงานป้องกันและปราบปรามการทุจริตและประพฤติมิชอบ (ตามคำสั่งกระทรวงการต่างประเทศ ที่ ๑๓๐๐/๒๕๖๑ ลงวันที่ ๒๐ ธันวาคม ๒๕๖๑)

On 24th July 2012, the Cabinet approved a resolution to establish an Anti-Corruption Operation Center in each public administrative unit, in accordance with the strategic framework, approach and proactive action plan of the government in fighting against corruption.  Such attempt aimed to enhance Thailand’s anti-corruption measures to reach universal standards, create a positive image, along with trust and reliability in the public administration of the nation.

The Cabinet introduced its policy to the National Legislative Assembly on 12th September 2014, emphasising on the promotion of good governance in public administration, prevention and suppression of corruption and misconduct in the government sector, and amendment of law and judicial process as crucial policies for the government’s administration. In addition, the National Council for Peace and Order issued the Order No. 69/2557, concerning prevention and suppression of corruption and misconduct measures on 18th June 2014. The Order stated that every administrative unit and government agency must specify measures or approaches to prevent and suppress corruption and misconduct in its organization and co-operate with other sectors in tackling corruption in a way that would respond to the needs of society and the population, with enduring outcome.

On 19th August 2016, the Prime Minister announced the suppression of corruption as a ‘national agenda’, stressing that the problem can be addressed by fostering awareness in individuals, families, schools, communities, the society, and the nation, alongside the promotion of virtue, morality, ethics and good governance values.

The anti-corruption mechanisms in the government sector constitute the following three levels:

                1) At the policy level:  the National Anti-Corruption Committee chaired by the Prime Minister / Head of the National Council for Peace and Order (in accordance with the Order of the National Council for Peace and Order No. 14/2558, dated 27 October 2015).

                2) At the national level: the National Anti-Corruption Commission Center established within the Office of Public Sector Anti-Corruption Commission (PACC), functions as a coordination mechanism and driving force for the overall progress in the country. The Center is chaired by the Minister of Justice (in accordance with the Order of the Office of the Prime Minister No. 226/2557, dated 24th November 2014).

                3) At the operational level: the Anti-Corruption Operation Center established at ministry’s level. It serves as a mechanism for executing preventive and anti-corruption plan and promotion and protection of ethics within the organisation. The Deputy Permanent Secretary of the Ministry is the chief of the Center (in accordance with the Cabinet Resolution, dated 24th July 2012).

 

The operation of Ministry of Foreign Affairs

                1. Ministry of Foreign Affairs has established the Anti-Corruption Operation Centre under the Office of the Permanent Secretary, responsible for the integration and implementation of preventive and anti-corruption plan and the promotion and protection of ethics within the Ministry. The Center is accountable to the Permanent Secretary and has its power and duties in accordance with the ministerial regulation on the administrative organisation of the Office of the Permanent Secretary , Ministry of Foreign Affairs (issue No. 3) B.E. 2556 (2013), dated 5th August 2013. Afterwards, Ministry of Foreign Affairs issued an Order to establish a working group in its Anti-Corruption Operation Centre on 30th June 2014 consisting of representatives from various agencies within the Ministry.

                2. In order to update and ensure the effectiveness of the Anti-Corruption Operation Centre, Ministry of Foreign Affairs has appointed the Deputy Permanent Secretary responsible for missions on foreign affairs promotion as the chief, and the Ambassador Attached to the Ministry as the deputy chief of the Anti-Corruption Operation Centre. Government officers in the Office of the Permanent Secretary have also been appointed as practitioners in the 1) Ethics Protection Unit and 2) Prevention and Suppression of Corruption and Misconduct Unit (in accordance with the Order of Ministry of Foreign Affairs No. 1300/2561, dated 20th December 2018).
